In Nevada, if you operate a vehicle with a BAC at or above the legally-defined threshold, you are committing an impaired driving offense. Also, you can still be arrested and convicted for driving under the influence (DUI) with a lower BAC reading or for driving under the influence of controlled or prohibited substances.
